1. Definitions and Scope
Parties: The company ODM 1295 S.r.l. ("Merchant") with registered office at Via Bissa 33, 30173 Venezia Italy, and the User/Customer who accesses and uses the Website.
Website: The e-commerce platform available at www.girendupre.com, managed on Shopify technology.
ToS: These Terms of Service that regulate access, Browse, orders, and contractual relationships between the Merchant and the Customer.
Products: Watches and accessories digitized and presented on the Website.
These ToS apply to all users who purchase or browse Products on the Website from the moment of their publication.
2. Registration, Account and Credentials
Purchases can also be made without registration; however, to access dedicated services (order history, wishlist), it is necessary to create an account.
The User guarantees the truthfulness and timeliness of the personal data entered.
Credentials (email and password) are strictly personal and non-transferable. Every access is considered, for all purposes, as having been made by the User themselves.

3. Orders and Sales Contract
The contract is concluded via "click to buy" and the sending of an order confirmation email.
The Merchant reserves the right to cancel or refuse orders in case of price errors, unavailability, or suspicion of fraudulent use.
Standard processing times for items indicated as available are approximately 2-5 business days.
4. Prices, Taxes, and Payments
Prices are expressed in Euros and include Italian VAT (22%) if applicable.
Shipping costs are indicated in the cart and vary based on weight, volume, and destination.
Accepted payment methods: credit cards (via Shopify Payments), PayPal, bank transfer in advance.
Any bank fees are the responsibility of the Customer.
5. Shipping and Deliveries
We ship to Italy and the EU via express couriers (DHL, UPS, FedEx).
Estimated costs and times (approximately 1-4 business days) are shown at checkout.
In case of delays due to force majeure (strikes, weather events), the Merchant is not responsible.
A tracking number is provided via a shipping confirmation email.
6. Right of Withdrawal, Returns, and Refunds
The private Customer has the right of withdrawal within 14 days of receipt (Legislative Decree 206/2005). To exercise this right: send an email to info@girendupre.com with the order number and the withdrawal form.
Return shipping costs are the responsibility of the Customer, unless otherwise agreed in writing.
A refund for the amount of the returned Products will be issued within 14 days of goods collection and integrity verification.
Personalized Products (ad hoc orders, engravings, customizations) are not subject to withdrawal.
7. Legal Guarantees and Limitation of Liability
Legal guarantee of conformity for new goods: 24 months from delivery.
Defects covered by the guarantee: conformity, manufacturing defects. Exclusions: damage from improper use, normal wear and tear.
The Merchant is not responsible for indirect damages or loss of profit.
8. Intellectual Property
All content on the Website (texts, images, logos, trademarks) is protected by copyright and industrial property rights of their respective owners.
Any unauthorized reproduction is prohibited.
9. Privacy and Cookies
For the processing of personal data, our [Privacy Policy] and [Cookie Policy] apply, which are available in the footer.
The Customer can exercise their GDPR rights (Articles 15-22 of EU Regulation 2016/679) by sending a request to info@girendupre.com.
10. Modifications to the ToS
The Merchant reserves the right to modify the ToS at any time.
Modifications will be published on the Website with at least 15 days' notice.
Continued use of the Website after the effective date implies acceptance of the modifications.
11. Applicable Law and Competent Court
These ToS are governed by Italian law.
For disputes, the Court of Venice is competent, without prejudice to the right of the consumer Customer to resort to their local court.
Within the EU, the Customer can use the ODR platform: https://ec.europa.eu/consumers/odr.
